A 43-year-old man, Johannes Tebogo Motse, has been sentenced to six years of direct imprisonment by the Specialised Commercial Crime Court in Rustenburg for posing as a legal practitioner and defrauding unsuspecting clients.
Motse pleaded guilty to three counts of fraud, one count of theft, two counts of forgery, and two counts of uttering. Between February and November 2022, he unlawfully represented clients in various courts, using forged documents, including a right of appearance certificate, a fidelity fund certificate, and an admission certificate.
One of his victims paid him R15,000 to prosecute an appeal — a service that was never rendered. A police investigation revealed that Motse was not registered with the Legal Practice Council.
In sentencing, the court took into account the seriousness and premeditated nature of the crimes. While the fraud, forgery, and uttering charges resulted in six years of direct jail time, the theft charge was suspended for five years, provided Motse repays the R15,000 by 31 August 2025.
He was also declared unfit to possess a firearm.
